Mother Nature's fees

By not playing Saturday’s volleyball match on Maui because of the tsunami warning will cost UH about $7,000 in non-recoupable expenses such as advertising, marketing and deposits, according to athletic director Jim Donovan.

That figure does not include the expenses BYU will incur for staying an additional two nights in the islands.

But UH should be able to make up for the refunded Maui ticket sales with the gate for tonight’s rematch in the Stan Sheriff Center. All seating is general admission, with ticket prices ranging from $3 to $8 depending on your birth date. First serve is at 6 p.m.

There should be news this week, either way, on linebacker Brashton Satele’s appeal for an exemption that will allow him to play as a sixth-year senior.

Three UH coaches gave depositions last week in the on-going Daniel Smith case. Smith is arguing that UH reneged on an offer to give him a scholarship in February 2008. UH is arguing that the assistant coach who made the offer did so without authorization, and that any oral offers were non-binding after June Jones resigned as UH head coach three weeks before the 2008 signing date.

    1. UH pays. Fortunately UH Office of General Counsel is defending UH and coaches except Jeff Reinebold, so there is some cost savings as far as attorneys’ fees are concerned (they are on salary). Do not know who is paying the Cades Schutte firm for defense of Sun God, although most of the legwork, based on defense case filings, has been done by UH General Counsel. UH has subpoenaed records from a number of out-of-state entitiles like Boise State and most recently from Whitter (is Smith there now?), and the costs associated with obtaining the records are hards costs thast UH has to pay.

    BTW, according to court records, the Smiths noticed the depositions of Mack, Ron Lee and Rich Miano. The Smiths also noticed the depositions of Doris Sullivan and Keith Amemiya. We can speculate as to why they’d depose Doris and Keith since they were not involved in this. Unclear whether UH actually deposed Daniel Smith and his mother Wanda, although it appears that they were rescheduled three times since a second amended notice (i.e., initial notice plus two amended notices) had to be filed for their depositions.

    2. This may be an all or nothing deal. If UH gives in, then it may encourage others to bring actions against UH and against NCAA member institutions. The Smiths’ attorney called into the Jeff Portnoy show some time ago and argued about the merits and principle of their claim. Jeff really could not say much because his partner represented Sun God by that time.

    3. Your guess is as good as anyones. The Smiths appear to be people of some means, and they seem to view this as crusading a cause.

    4. Who knows? Maybe its buried in some public financial report.

    5. As an outsider, don’t know what has been discovered in litigation. With that said, one could play the morals card. It has been reported on a message board post a while ago that Daniel moved from North Carolina to Idaho during his senior year to avoid the negative effects of throwing an underage drinking party (sounded like the kind on “Risky Business”, Weird Science” and Sixteen Candles”. There was an actual article that the poster had a link to. The police in Wilmington or wherever he was in North Carolina sought to question him, but he was out of their reach. This may have impacted his recruiting. Don’t know if UH was aware of it or not, but this could be a reason to pull a scholarship offer. I am aware of the Hanohano-Jervis egg incident, but that happened after NLI signing.

    It is understood that verbal scholarship offers are nonbinding, and either side can “decommit.” That is the nature of the recruiting process. UH’s seems to have taken the position from the get-go that Sun God was not authorized to offer Smith a scholie. JJ must be in agreement since he was the captain of the ship” at the time.

    Only opinions based on media and other reports. Take this with a grain of salt.

    It is quite sad that the San Francisco Chronicle, Houston Chronicle, San Antonio Express-News, and the Seattle Post-Intelligencer will run articles written for the Bleacher Report right next to the articles from their sportswriters. Instead of paying for real journalists to write their stories, they will use Bleacher Report articles where the writers do not need journalism degrees or any background in sports and are paid little or nothing for their articles.

    Hearst Newspapers, owner of the San Francisco Chronicle, made a deal with “citizen sportswriters” business Bleacher Report for some of the news in its sports section.

    The “co-branded” sports news will appear on the Chronicle’s SFGate web site, along with the web sites of the Houston Chronicle, San Antonio Express-News and the SeattlePI.com web site

    Bleacher bills itself as “the world’s largest publisher of exclusively fan-generated sports reporting.”

    I believe UH has acknowledged that Reinebold made an offer. What is at issue now is whether 1) he was authorized to make an offer. 2) if it was decided UH would withdraw the offer early, did Reinebold continue to lead Smith to believe he still would receive an offer? 3) did Smith forgo other offers by believing he had an offer from UH? 4) is a new coaching staff obligated to honor promises made by the previous staff.

    Garret..Bleacher reports?…Yikes, what has news reporting come to!?
    Depending on who is “reporting”, it could be good information or not. On this blog, we get some good info. from “Tsai-ko Reporters”. They have been time and content tested though. With the excellent job our host does, we can pretty much know what ever he post is “pono”.
    “Bleacher creature reporters” may be another thing though. How does the publisher quality check the story? If they do that, they might as well have their own reporters do the story…
    The pros in the business have a lot at stake, mainly their credibility and reputation. Will bleacher creature reports have the same level of checks/accountability? I guess that some will turn out to be good reporters but I think a lot of these reports will be “leaks”. Especially if they will get paid for their reports. Organizations will need to be much more careful with information management.

    Sorry for the typos in my earlier post.

    FYI, there is a settlement conference scheduled for March 15th with Judge Sabrina McKenna. Maybe they can come up with a compromise that is acceptable to all parties. The jury-waived trial is set for June 28, 2010 before Judge Eden Elizabeth Hifo (but she retired at the end of 2009, so who knows who the presiding judge will be?). Not sure if Judge McKenna will handle the settlement conference either since she is no longer with the civil division – she is now the Senior Judge of the Family Court of the First Circuit.

    By rule, discovery must be completed 60 days before the trial date. It is, as they say, time to fish or cut bait.

    Best tho, to have it reduced to writing and signed and dated by all parties to the agreement.

    to me its a matter of bottom line.
    one more year of what we had this year will bring the mbb program to a point where it will take another five years to pull its okole out of you-know-where.

    the root of the evil is the poor recruiting. should nash get another year and i, too, don’t rule this out. then, nash needs to go find another recruiter yesterday. oh he has the numbers to bring in. but, since he would be on a short fuse he’ll need to find one or two jc ballers to go along with a couple of players from the hs ranks.

    can he pull it off?

    that is the question for jd. going out to spend double on a new coach’s salary might be feasible considering if we go further in to the pits it could cost the university more money in the long run with any further decline in revenues.

    Duster, great analysis as always. Is RA still handling lead? Not a knock on him at all, but it would be nice if there were a battle-hardened vet actively involved on a day to day basis. Two heads are always better than one and three even better than two. I would think that this is a case that could be won or nearly won in deposition. I’m assuming there is no enforceable K and the issue is therefore just reliance. But how reasonable was that?

    And, has JJ’s depo been done yet? His word would seem to be key, wouldn’t it? Any reason to worry that P’s counsel was a Pony or is that just my ordinary paranoia?

    Anyway, what I really wanna know is whether you corrected the record about a certain foot race. My statute of limitations may have run, but you sure didn’t. Or, maybe just a little. But, as you know, if that had been short track speed skating, there would definitely have been a disqualification.

    Regarding Nash we can strictly look at salaries. Just throwing numbers out there but if a new coach was paid 250K more plus we have to buy out Nash for 250K that’s an increase of 500K to the operating budget. However, if the new coach gets 1K more fans in the seats for 18 home games that’s 18K more fans who are paying $20 bucks a ticket for 360K incremental so the loss is only 140K. Who knows if the coach can put out a good product we might be able to break even.

    You are thinking on the same wavelength as I am. Good depositions can make the UH’s case. My recollection from the Jeff Portnoy Show where Smiths’ counsel called in (and it was him – I recognized his voice) is that they were relying on the promissory estoppel/detrimental reliance theory. Not sure if reliance on a verbal offer (which was apparently in e-mail(s)) is reasonable when it appears to be common knowledge that an NCAA member institution is not bound until the recruit signs and the institution receives it via fax, hand delivery or mail. As we know from the Jeremy Perry incident, signature and no send does not bind anyone. The Smiths’ contention from the outset has been that they declined other offers after they verbally committed to UH.

    Your post made me think of that Ravelo vs. County of Hawaii case from 1st year contracts on promissory estoppel. The most recent case to cite Ravelo is Morgado vs. Hamada, which is a summary disposition from the ICA in April 2009. It involved the rescission of an offer of a year-to-year coaching contract between Kauai High and Kelii Morgado. In Morgado, the court reviewed the summary judgment entered for the State and noted:

    “[I]n order for an oral contract to be enforceable, there must be an offer, an acceptance, and consideration. Douglass v. Pflueger Hawaii, Inc., 110 Hawai`i 520, 525, 135 P.3d 129, 134 (2006). Viewing the evidence in the light most favorable to Morgado and assuming that the parties in fact agreed upon a certain time period, Defendants could nevertheless have rescinded their offer before the end of that period unless Morgado gave them consideration or a consideration substitute (e.g., detrimental reliance). See Ravelo v. County of Hawaii, 66 Haw. 194, 199-200, 658 P.2d 883, 887 (1983) (holding that Ravelo and wife had a claim under the promissory estoppel doctrine, where they detrimentally relied on the county’s assurance of employment at a definite time).”

    I am sure that Smith’s counsel is well aware of the Morgado case (and has all the pleadings and research files) because his firm represented one of the defendants. If the State can obtain summary judgment (i.e., judgment by motion without having to go to trial) and have it affirmed on appeal in a situation where an offer was made then rescinded, perhaps the Smiths should look for a graceful exit. Seems to me that schools were not beating down Smith’s door to sign him when he “became available” to establish detrimental reliance. His off-field incident may have also been a factor. Otherwise, some FBS school would have offered during the three week period after Mack took over and before NLI day, eh?

    Anyway, regarding that race – there was no replay for the judges to review to DQ anyone. I think I may still have the photo that FL took at the finish line, though.

    I think that after Sealy got the UCLA job some fans, like myself, will cease to assume that the heir to the Wahine Volleyball throne lies beyond the coaching staff.

    With respect to Sealy’s replacement and Coach Ambrozich its hard to imagine or guess that Shoji is “grooming” anyone right now as his eventual replacement.

    Unless that person is ummm.. down the hall? 😎

    Just wanted to congratulate Farrington H.S. alumnus Shawn Lauvao who is competing at the NFL combines in Indianapolis. He placed in the top 5 or 6 for all offensive linemen in the bench press and the 3 cone drill and he paced first of all of the offensive linemen in the 20 yard shuttle run.

    Great fun at the vb game tonight. Small contingent of Tsai-kos. Small but vocal crowd. Didja hear Stretch and A-joe? 😆 Keed and friend thought they were very coool. :mrcool:

    Keed and friend got to be the ball girls for the 2nd & 3rd game. They loved it. We discussed getting season tickets for next year. 😀

    East Carolina comes to Hawaii with a 6-7 softball record. Five Island girls are on the team, 2 from Kamehameha, 1 Punahou, 1, Kapolei, and 1 from Pearl City. East Carolina recruits Island girls for softball and soccer.

    K State ranked top 5, first time in 50 years. Last time K State was ranked that I high, I got to watch them as a student with Tex Winter coaching. Coaching makes a difference, when he left, a slow downslide that took decades to recover. Frank Martin took over for Huggins at K State, his first head coaching position. Three consecutive 20 game seasons. Can Hawaii do it, probably, find the right coach and not hire a “feel good” kind of coach because he knows Hawaii. Alford has taken New Mexico to a top ten, when can’t we get there?

    If New Mexico can afford Alford why can’t UH. New Mexico average between 25K and 30K for football, and 13000+ for bb. UH has better numbers in fb, very low in bb, but expected when you lose and play uninspiring basketball.
