Tachibana suspended
Head coach Norm Chow today suspended linebacker ย Alema Tachibana from team-related activities pending the resolution of his drunken-driving case.
Tachibana was arrested in Kalihi on June 18. He was released after posting $500 bail.
Through attorney R. Patrick McPherson, Tachibana entered a not-guilty plea today in District Court. Tachibana was not in attendance.
The trial is set for Oct. 15.
Tachibana, a junior linebacker, is a 2008 Kahuku High graduate. He has been participating in the Warriors’ offseason conditioning program.
Chow said Tachibana will remain on scholarship and is permitted to attend classes.

Being that he was arrested on suspicion of DUI and he entered a not guilty plea is that still a violation of team rules because he has not yet been officially found guilty of it yet.

Good question. Tachibana “faces” an indefinite suspension. If innocent until proven guilty, then is the player’s status still “eligible”? If so, and the hearing date is set at a future date past say…the USC game, will the player be eligible to play? Maybe even punt?

I have sat on DUI juries several times all of which resulted in a conviction.Juries tend to side with the police in DUI cases even when the evidence is borderline.
The biggest waste of time was a DUI case I sat on that lasted two days. It as an older lady,consider to be a fine upstanding citizen by the defense witnesses.. The States evidence was absolutely flawless.
When we got to the summation her defense attorney concluded with this statement.How do I know she is innocent ? Well,she’s my mother.
I can’t tell you how much strength it took for me to keep from rolling on the floor in laughter.
In other news, Syracuse officially leaves for the ACC next season paying an exit fee of 7.5 million. Pitt, however, still awaits a BE decision, but believe they’ll be allowed to leave the same time as Syracuse.

Tachibana’s brothers mother in law was killed by a drunk driver not 2 weeks ago. We all read about that one. I hope he has learned his lesson.

Sometimes, I think about my younger days & drinking & driving, & marvel that I somehow escaped being nabbed for DUI. I always felt then that “I can handle.” Not so anymore….if any doubts, I hand my wife the keys.
I wish Tachibana, Dunnachie, & Shutter well & hope things work out OK for them. These guys have great opportunities, and the responsibilities that go w/ them, that many others can only dream about.

This is really a first step– He will plead not guilty now and negotiate a plea or no contest arrangement.
The point was brought up, and I concur, that if a player is presumed innocent of a charge than what justification does the UH athletic dept have in suspending a player before adjudication of the case?—-the mere appearance of guilt is not the same as guilty…at least in a democracy. The school should await the verdict before they impose a punishment. But, they have not done this, the punishment has already begun before the court case.
I realize both views can be argued, for that reason alone no penalty should be levied yet.

Sometimes, you get lucky and the arresting cop can’t attend the trial because he went to Afghanistan as a reserve soldier. When that happens, the judge dismisses the case without prejudice, which means it can be resurrected later. But it is a dismissal nonetheless. Don’t know how that outcome will affect the player’s suspension.

Actually, it would seem that Tachibana should have pled guilty IF Chow would only suspend him for 4 games. In this situation, Tachibana is suspended from activities and games till his October hearing which means he’ll miss a few games and possibly more once the verdict is made…
IMHO…In Dunnache’s case, I’d have a hard time being in Chow’s shoes, as I’d have the inclination to kick him off the team especially since the offense occurred after a team meeting which addressed drinking, etc. Respect for the coach and the team needs to be established or…there is no “team” functionally.

Breaking team rules is one thing..being arrested, than pleading ‘not guilty’ to the charge tacitly implies he was mistakingly arrested until such time that a guilty verdict is found at his trial. Whats hard to understand about that? Tachibana is saying he did not do what is charged. How’s that breaking team rules? Am I missing something here?
Yesterday Alema was a guy facing charges. Today he pleads not guilty and now he is suspended? Bizarre. I don’t follow the logic on the timing here.
Stating the obvious, people who drink and drive should go to jail, whether it is you, me, a football player, or the anyone else, no exceptions.

So getting arrested breaks one of the three cardinal rules. Then Alex Dunnachie might as well forget the first eight games or so of the coming season. As a senior, this will really hurt his chances to be drafted. Four games may not provide enough kicks to establish him as one of the premier punters this season. Too bad. Gotta think about free agent contract I suppose.
Arrest and violating team rules are two different things and can carry seperate punishments.
Think of it this way.
You are a small kid who went to the store and you stole a pack up gum. You were caught for shoplifting and arrested by police. Case went to court and was dismissed due to insufficient evidence. You may be innocent in the eyes of the law, but that doesn’t mean you didn’t commit the crime of shoplifting.
Good to go? Not likely. Why? Your parents found out and now you going get lickens. ๐
In Tachibana’s case, he might be disputing the way he was arrested (unreasonable search and seizure). Proper procedures taken leading up to arrest might have been improper. For example, was there probable cause to pull him over; was the breathe test administered in a manner established by Hawaii law; did the arresting officer Mirandize you…etc. These are things that can suppress evidence and get you off. Its not so much on whether he was intoxicated and blew a BAC above .08. He could have blown a .15 and he could still plead not guilty and not be convicted.
Anywho, methinks the prosecutor’s office must be innundated with DUI cases when one considers the steady rise of DUI arrest over the years. I figure this works in Tachibana’s favor since he’s a first-time offender. Or one can hope.
Another factor that could work in Tachi’s case is if the judge and/or the prosecutor assigned to the case is a UH grad and a season ticket holder. ๐
If Alex doesn’t get any good looks from the NFL or any other pro team (AFL,CFL), he could always go back home and play Aussie football. Anyway, he will at least have his degree and that something to be proud of.

Pleading not guilty doesn’t mean the defendant didn’t do the crime, it’s just that he wants to go through the court system, and maybe the officers won’t show up for three of the hearings. was he driving under the influence… Yes… and he was arrested for that, his license was revoked, if he chooses to drive, then he installs a ignition lock system in his vehicle. A lot of the DUI defendants are looking for their case to be dismissed on technicalities or officers not showing up. But are thet guilty of the offense… Yes again. Sometimes people just need to “Man Up” and take the punishment.

Looks like the Big 10 and Pac-12 will make more with the BCS system over. Remember, each conference got $20 mil from the BCS, but if 1 of their teams made it to the national title game then a second BCS team playing in the Rose Bowl would only make $4.5 mil for their conference.

To be clear…On OVUII arrests or arrests in general, you need Probable Cause(PC) to effect an arrest. An officer arresting for OVUII does NOT need to read any rights to the arrestee, because there is no questioning going on. It is popularized in mainland shows such as COPS, that you are required to read miranda rights, that is true to a certain extent in Hawaii. The only time you will be read your constitutional rights by a HPD officer is if the crime committed is a misdeameanor or lower, and they believe they can close the case out at that moment.
Many OVUII attorneys place emphasis on procedural error, or lack of PC to avoid a conviction.
Being arrested means just that, you were arrested based on the Probable Cause that you have committed a crime. You get handcuffed and brought to Jail. No charges have been filed yet. Basically you are being held in custody until either you are issued a court date and released(Bail, Release Pending Investigation, Release on Own Recognizance, Release No Charge), or you are brought to court by HPD to face the judge.
Being Charged means that the prosecutor and/or Detective, found enough evidence in their investigation to file legal charges against you. You will receive paperwork of the charges, given a court date, and now you will need to find legal assistance if you have not done so already, either state appointed or through private channels.
Hopefully that clears up any confusion…

If team rules say don’t get arrested and you got arrested, you broke a rule.
It’s pretty simple to me….it’s like state law and federal law. Besides, each student athlete signs and agrees to a certain athlete code of conduct. If a person signed and agreed that they will not get arrested…and later got arrested…sorry charly, you signed on the dotted line the you would “not get arrested”. The outcome of innocent or guilty is mute.
