Mother Nature's fees
By not playing Saturday’s volleyball match on Maui because of the tsunami warning will cost UH about $7,000 in non-recoupable expenses such as advertising, marketing and deposits, according to athletic director Jim Donovan.
That figure does not include the expenses BYU will incur for staying an additional two nights in the islands.
But UH should be able to make up for the refunded Maui ticket sales with the gate for tonight’s rematch in the Stan Sheriff Center. All seating is general admission, with ticket prices ranging from $3 to $8 depending on your birth date. First serve is at 6 p.m.

Spring training doesn’t open until March 31, but the linemen have been battling at Ching field. Each of the upper classmen has taken a leadership role. Today, it was Austin Hansen and Laupepa Letuli leading the drills.

Paipai Falemalu (L)

There should be news this week, either way, on linebacker Brashton Satele’s appeal for an exemption that will allow him to play as a sixth-year senior.
* * * * *
Three UH coaches gave depositions last week in the on-going Daniel Smith case. Smith is arguing that UH reneged on an offer to give him a scholarship in February 2008. UH is arguing that the assistant coach who made the offer did so without authorization, and that any oral offers were non-binding after June Jones resigned as UH head coach three weeks before the 2008 signing date.
Too bad about the financial loss.
It is sad that the Daniel Smith case is still going on!
Best wishes for Brashton…UH can use him next season!
At least Brashton will know about his status before UH’s Pro Day if things do not work out.
Aloha Kakahiaka!
5th!!! Goodmorning everyone. Hope you all have a good day. I know I will.
Good morning all!
Top 10, by golly!
Does Daniel Smith play football anywhere?
@Al
just for the record Stretch & PP would have kicked butt if the match was played. Rob was the backup.
lets see…. tsunami hawaii or freezing provo???
or even just
Hawaii or Provo????
hmm…… tough choice.
Go VolleyBows… Beat BYU again…
Number 1 two times!!!
That would be number 11 and number 12! 😆
Let’s hope that things work out for Brashton.
Good morning errybody!
Happy Monday!
Felíz cumpleaños Curveball!
Hoping to go to the game tonight. Depends on keed’s homework load.
hiho!
Must be strong… Mustn’t post ten times in a row like certain bipolar psycho bloggers… Must fight!
jm2375!
Thank God you’re here!
😆
I wonder if whitey and sleaze had non-recoupable expenses because of the cancellation? Do they give refunds at the darkside?
whooootahhhhhhhhhhh such a chilly morning, must really suck to have to go to work today. if you have to best wishes, have a good one and play nice
good luck to the warrior vballers tonight
one cup of kope then I go…………back to the warm de bed
Best of wishes to Brashton Satele. Man the Warriors could use a healthy Brashton this season.
ST – Is it me or this Daniel Smith case is a waste of everybody’s time? I mean a verbal offer IS non-binding isn’t it…? I don’t get the beef…hhmmm.
Dpk ~ Sending Lassie. Hang on!
Sending Timmy a Google map with directions for Lassie.
EXACTLY!! I think the kids did a Tsunami dance the night before because they was scared to play us.
a little tweaking of duffer’s quote here makes his statement more plausible…
“just for the record Stretch & PP would have had their butt kicked if the match was played. Rob was the backup.”
Stretch – #22 – NOT!!
Too bad for the Oregon baseball team, they couldn’t use the Tsunami warning on Saturday as an excuse… They didn’t play like a Top 25 team before the warning came out anyway! 😆
Good chilly morning to all Tsaikos….it was mighty cool up in the highlands of Chinese Heaven…I think it must be that 1400 foot elevation that is reallyd driving the cool winds……MWHAHAHAHAHAHAHA
Happy Birthday Curveball….we’ll have to celebrate sometime soon…..
Okay gang, gotta go…..unlike Gramps, I do have to work…MWAHAHAHAHAHA
Questions for our Tsaiko Legal Beagles:
1. Who pays for this BS law suit at this point?
2. Are they hanging on to squeeze a settlement from UH?…or do they want the whole Enchilada?
3. How do we make them drop and move on?
4. What’s this thing cost UH to this point?
5. Bhf2, any ideas on how to push back?
(Jesse)James,
haha, the buggah went back to warm his bed.
al…yeah, he calls that his Church of St. Mattress…..LOL
Aloha Kakahiaka!
Happy birthday, Curveball!
Hope the game tonight is sold out to make up the loss.
Happy Birthday to Slider’s Grandpappy, Curveball.
Shouldn’t BYU be able to stay at the Marriott for free considering it is owned by the Mormon Church? 🙂
BIK
what ever happened to the Daniel Smith dude?
did he ever end up playing for anybody else?
Good morning everyone!
Happy Birthday to Curveball da Sailor !!!>/b>
Happy Birthday Curveball!
Re: #27
1. UH pays. Fortunately UH Office of General Counsel is defending UH and coaches except Jeff Reinebold, so there is some cost savings as far as attorneys’ fees are concerned (they are on salary). Do not know who is paying the Cades Schutte firm for defense of Sun God, although most of the legwork, based on defense case filings, has been done by UH General Counsel. UH has subpoenaed records from a number of out-of-state entitiles like Boise State and most recently from Whitter (is Smith there now?), and the costs associated with obtaining the records are hards costs thast UH has to pay.
BTW, according to court records, the Smiths noticed the depositions of Mack, Ron Lee and Rich Miano. The Smiths also noticed the depositions of Doris Sullivan and Keith Amemiya. We can speculate as to why they’d depose Doris and Keith since they were not involved in this. Unclear whether UH actually deposed Daniel Smith and his mother Wanda, although it appears that they were rescheduled three times since a second amended notice (i.e., initial notice plus two amended notices) had to be filed for their depositions.
2. This may be an all or nothing deal. If UH gives in, then it may encourage others to bring actions against UH and against NCAA member institutions. The Smiths’ attorney called into the Jeff Portnoy show some time ago and argued about the merits and principle of their claim. Jeff really could not say much because his partner represented Sun God by that time.
3. Your guess is as good as anyones. The Smiths appear to be people of some means, and they seem to view this as crusading a cause.
4. Who knows? Maybe its buried in some public financial report.
5. As an outsider, don’t know what has been discovered in litigation. With that said, one could play the morals card. It has been reported on a message board post a while ago that Daniel moved from North Carolina to Idaho during his senior year to avoid the negative effects of throwing an underage drinking party (sounded like the kind on “Risky Business”, Weird Science” and Sixteen Candles”. There was an actual article that the poster had a link to. The police in Wilmington or wherever he was in North Carolina sought to question him, but he was out of their reach. This may have impacted his recruiting. Don’t know if UH was aware of it or not, but this could be a reason to pull a scholarship offer. I am aware of the Hanohano-Jervis egg incident, but that happened after NLI signing.
It is understood that verbal scholarship offers are nonbinding, and either side can “decommit.” That is the nature of the recruiting process. UH’s seems to have taken the position from the get-go that Sun God was not authorized to offer Smith a scholie. JJ must be in agreement since he was the captain of the ship” at the time.
Only opinions based on media and other reports. Take this with a grain of salt.
Mahalo, Duster, for the inside scoops.
Gmorning Gang!
thanks duster.
…nuff said.
Good noontime today.
Didn’t coach Glanville get Daniel Smith up to Portland State? I think i remember reading that awhile ago. Great weekend for Warrior sports by the way!
neva buy a car with a programable gps. somehow the darkside merchants programmed my gps and the car wouldn’t go home. it kept going from one merchant to another and finally i disconnected the gps and made it home.
after further review, been going to the darkside and neva had problems getting home in the past, then I remembered, Stretch and Sleeze was with me, but took Stretch to pick up his car. Me and Sleeze had hard time going home.
Stretch is an engineer, so he must have programmed the car when me and Sleeze wasn’t watching. I going have my CSI friends check for fingerprints.
It is quite sad that the San Francisco Chronicle, Houston Chronicle, San Antonio Express-News, and the Seattle Post-Intelligencer will run articles written for the Bleacher Report right next to the articles from their sportswriters. Instead of paying for real journalists to write their stories, they will use Bleacher Report articles where the writers do not need journalism degrees or any background in sports and are paid little or nothing for their articles.
Mahalo Duster. Let’s hope for the ‘positive’ aspects of the case to help stop the bleeding.
Duster is actually keenly accurate on all points.
I believe UH has acknowledged that Reinebold made an offer. What is at issue now is whether 1) he was authorized to make an offer. 2) if it was decided UH would withdraw the offer early, did Reinebold continue to lead Smith to believe he still would receive an offer? 3) did Smith forgo other offers by believing he had an offer from UH? 4) is a new coaching staff obligated to honor promises made by the previous staff.
guessing answers to #45-
1) Yes; 2) No; 3) Yes; 4) No. PAU ALREADY! NEXT!
ST,
Sorry if I missed this earlier if you mentioned it but when will Grgas be ok to play again?
Duster,
Mahalo for your post!
Curiosity – who is JJ attorney? just asking cause he was the HC and Sun god was his asst coach who apparently made the offer with his blessing?
What did JJ tell his staff about recruiting once he made an annoucement he was resigning and accepted the SMU job?
Kazz:
Coach Wade made a statement that Grgas would be available tonight with some sort of “protective” cover for the injury – maybe as a “back-up”?
A very long time ago in my first year law school contracts class, it was drummed into our impressionable minds that if it ain’t in writing, there ain’t no deal that will stand up to a challenge. Has contract law changed that much?
Stephen: I heard the term “Sports Management Major” mentioned twice during Senior Night. Where is the program located – Shidler School of Business or the Department of Athletics? Everyone I know who works in the field is an attorney or has an MBA. Would be interesting to learn more about the program here..
Time to wuz out of here – “see” you tomoght.
ST –
I don’t know man, seems Judge Judy would WIG-OUT if such a lame case ever entered her court room.
I mean it all sounds ridiculous!
Had the shoes been reversed, if that kid, ANY kid for that matter made a verbal commitment to a school then later changed his mind, could the school sue him…?
I think not.
I’m no lawyer, but I’ve seen almost every episode of Law & Order, I’m sure Jack would make minced-meat out of this case. Heck, even Michael Green locally might wanna go to trial with this one instead of cut a deal.
Garret..Bleacher reports?…Yikes, what has news reporting come to!?
Depending on who is “reporting”, it could be good information or not. On this blog, we get some good info. from “Tsai-ko Reporters”. They have been time and content tested though. With the excellent job our host does, we can pretty much know what ever he post is “pono”.
“Bleacher creature reporters” may be another thing though. How does the publisher quality check the story? If they do that, they might as well have their own reporters do the story…
The pros in the business have a lot at stake, mainly their credibility and reputation. Will bleacher creature reports have the same level of checks/accountability? I guess that some will turn out to be good reporters but I think a lot of these reports will be “leaks”. Especially if they will get paid for their reports. Organizations will need to be much more careful with information management.
The Question ST lists in #45 shows that the courts have in fact found that verbal offers (not on paper) can have merit.
BIK
Sorry for the typos in my earlier post.
FYI, there is a settlement conference scheduled for March 15th with Judge Sabrina McKenna. Maybe they can come up with a compromise that is acceptable to all parties. The jury-waived trial is set for June 28, 2010 before Judge Eden Elizabeth Hifo (but she retired at the end of 2009, so who knows who the presiding judge will be?). Not sure if Judge McKenna will handle the settlement conference either since she is no longer with the civil division – she is now the Senior Judge of the Family Court of the First Circuit.
By rule, discovery must be completed 60 days before the trial date. It is, as they say, time to fish or cut bait.
In Business Law, at UH, we were taught that a “verbal agreement – offer and acceptance between 2 parties is a legal and binding contract.
Best tho, to have it reduced to writing and signed and dated by all parties to the agreement.
Is college football or any other athletic offer/acceptance bound by the same rules?
Verbal agreements, akin to “hand shake” agreements can have standing in a court of law.
Settlements are ok. Save some $ but will not answer who made a boo boo and will it offer some guidance in the future?
ST..mahalo for the pics…look like some future coaches out there
mbb
i am hearing all the opinions from st, ferd, and others.
to me its a matter of bottom line.
one more year of what we had this year will bring the mbb program to a point where it will take another five years to pull its okole out of you-know-where.
the root of the evil is the poor recruiting. should nash get another year and i, too, don’t rule this out. then, nash needs to go find another recruiter yesterday. oh he has the numbers to bring in. but, since he would be on a short fuse he’ll need to find one or two jc ballers to go along with a couple of players from the hs ranks.
can he pull it off?
that is the question for jd. going out to spend double on a new coach’s salary might be feasible considering if we go further in to the pits it could cost the university more money in the long run with any further decline in revenues.
I prefer oral agreements.
further proof that this blog is real stuff.
so last night #2 was at a popular local watering hole and engages in a conversation with davone bess. #2 mentions that i won an autographed dolphin cap through the live chat.
davone acknowledges this and says, “yah, that was al.”
hahaha. he also said he didn’t know how to answer the question.
homey…too bad gigi no longer blogs.
i am sure that she would ask you what that meant.
brett leonard appears to have worn his redshirt real well.
looks bigger and thicker with more muscle.
i, too, believe that these lineman will benefit from the weight training.
Duster, great analysis as always. Is RA still handling lead? Not a knock on him at all, but it would be nice if there were a battle-hardened vet actively involved on a day to day basis. Two heads are always better than one and three even better than two. I would think that this is a case that could be won or nearly won in deposition. I’m assuming there is no enforceable K and the issue is therefore just reliance. But how reasonable was that?
And, has JJ’s depo been done yet? His word would seem to be key, wouldn’t it? Any reason to worry that P’s counsel was a Pony or is that just my ordinary paranoia?
Anyway, what I really wanna know is whether you corrected the record about a certain foot race. My statute of limitations may have run, but you sure didn’t. Or, maybe just a little. But, as you know, if that had been short track speed skating, there would definitely have been a disqualification.
paipai does appear to be filling out quite a lot.
…and potentially speaking,
i am picking waylon lolotai as the new kid on the block for the 2010 season. this based upon; what he did in high school, how much he has grown since his mission and redshirt years, and of course his genealogy.
al:
can you describe “new kid on the block”? does this mean only players who did not play last year?
speaking of “kid” – we watched previews of the “new” Karate Kid yesterday and the youngster is Wil Smith’s son!
al:
#66 – Paipai does look bigger – wonder how much weight/muscle he put on? looks to be 15-20# of muscle!!!
Regarding Nash we can strictly look at salaries. Just throwing numbers out there but if a new coach was paid 250K more plus we have to buy out Nash for 250K that’s an increase of 500K to the operating budget. However, if the new coach gets 1K more fans in the seats for 18 home games that’s 18K more fans who are paying $20 bucks a ticket for 360K incremental so the loss is only 140K. Who knows if the coach can put out a good product we might be able to break even.
In my previous post I meant to say we “can’t” strictly look at salary differences.
Happy birthday Curveball!
Certainly you two little ‘balls are helping you celebrate!!!
Hmmm, okay. That did not come out right. But you folks know what I meant.
HA!
Fast ball, slider, change up, split finger, spit ball, and curve ball – hey, I know a “curve ball” – yes, yes, Happy Birdfday fella!
Tomorrow is the last day to apply for Sealy’s job . Haven’t heard any leaks on candidates so far although Scott Wong at USF is a fan favorite.
Mojo:
It looks like RA is still lead for UH, with CT doing workup.
You are thinking on the same wavelength as I am. Good depositions can make the UH’s case. My recollection from the Jeff Portnoy Show where Smiths’ counsel called in (and it was him – I recognized his voice) is that they were relying on the promissory estoppel/detrimental reliance theory. Not sure if reliance on a verbal offer (which was apparently in e-mail(s)) is reasonable when it appears to be common knowledge that an NCAA member institution is not bound until the recruit signs and the institution receives it via fax, hand delivery or mail. As we know from the Jeremy Perry incident, signature and no send does not bind anyone. The Smiths’ contention from the outset has been that they declined other offers after they verbally committed to UH.
Your post made me think of that Ravelo vs. County of Hawaii case from 1st year contracts on promissory estoppel. The most recent case to cite Ravelo is Morgado vs. Hamada, which is a summary disposition from the ICA in April 2009. It involved the rescission of an offer of a year-to-year coaching contract between Kauai High and Kelii Morgado. In Morgado, the court reviewed the summary judgment entered for the State and noted:
“[I]n order for an oral contract to be enforceable, there must be an offer, an acceptance, and consideration. Douglass v. Pflueger Hawaii, Inc., 110 Hawai`i 520, 525, 135 P.3d 129, 134 (2006). Viewing the evidence in the light most favorable to Morgado and assuming that the parties in fact agreed upon a certain time period, Defendants could nevertheless have rescinded their offer before the end of that period unless Morgado gave them consideration or a consideration substitute (e.g., detrimental reliance). See Ravelo v. County of Hawaii, 66 Haw. 194, 199-200, 658 P.2d 883, 887 (1983) (holding that Ravelo and wife had a claim under the promissory estoppel doctrine, where they detrimentally relied on the county’s assurance of employment at a definite time).”
I am sure that Smith’s counsel is well aware of the Morgado case (and has all the pleadings and research files) because his firm represented one of the defendants. If the State can obtain summary judgment (i.e., judgment by motion without having to go to trial) and have it affirmed on appeal in a situation where an offer was made then rescinded, perhaps the Smiths should look for a graceful exit. Seems to me that schools were not beating down Smith’s door to sign him when he “became available” to establish detrimental reliance. His off-field incident may have also been a factor. Otherwise, some FBS school would have offered during the three week period after Mack took over and before NLI day, eh?
Anyway, regarding that race – there was no replay for the judges to review to DQ anyone. I think I may still have the photo that FL took at the finish line, though.
A-House
yah…like never played before. altho i think that allen sampson will give him a run for his money.
al:
hmmmmmmmm, goin to have to sleep on dis one – maybe Stutz2 may be in the running and the Beast!
blikeke:
You’re right. I keep hearing that Scott Wong is the logical replacement.
He was the runner-up, as I understand it, for the men’s job.
Wow…I’m getting the impression that Duster, who was one of the earliest bloggers here (since Aug 2006), might be a lawyer too. 😆
Hi WarriorMojo!
BTW, thanks for the info and insight.!
Hiya.
Speaking of Sungod…
Please remember him in your prayers. I believe he goes in for cancer surgery on Wednesday.
God Bless!
SteveM ~ I like the fact that Duster answered all of my questions as best he could. 😎
We do have some very sharp crayons in our cigar box. It’ll help keep us squeaky clean when we get ST’s restaurant up and running.
Duster is a sharp person.
we got lucky sat with the lack of tsunami. found this article about the tsunami that hit chile right after the quake. scary. better to be safe than sorry.

BTW, if I am sharp, I am only as sharp as a marble.
I think that after Sealy got the UCLA job some fans, like myself, will cease to assume that the heir to the Wahine Volleyball throne lies beyond the coaching staff.
With respect to Sealy’s replacement and Coach Ambrozich its hard to imagine or guess that Shoji is “grooming” anyone right now as his eventual replacement.
Unless that person is ummm.. down the hall? 😎
Ralph,
Seems like we should have won the Oregon game.
With another ACE it would be fun to see Na Wahine light her up as we did with Chinn.
That’s why they play the game yeah?
Good grief… Steve Hunt spiked a ball that bounced off the scoreboard and landed in my lap. I’m sitting here in the second row and I couldn’t even toss it back to him….
Now that’s LAME! 😳
Hmmm.. Nejc looks to be more than focused during warm-ups. Looks like he’s gonna have a good game tonight.
Or did I just jinx him? 😯
Those folks look big in the pix. Oh and the guys, too.
I am probably going to pay for that one. HA!
Not only can Jonas play vball, he can juggle too.
Go Warriors tonight!!
Sure missed Kazz at the QB Club today.
Coolen and his assistants were the speakers.
Good luck to the mvb team on their delayed game.
Tonight, leave no doubt.

Just wanted to congratulate Farrington H.S. alumnus Shawn Lauvao who is competing at the NFL combines in Indianapolis. He placed in the top 5 or 6 for all offensive linemen in the bench press and the 3 cone drill and he paced first of all of the offensive linemen in the 20 yard shuttle run.
just out of curiosity, which players on the mvb team were recruited by Coach Wade????
Good evening Tsaikos everywhere.
Kekoa, re your question to me, better go ask Duster. 😀
i stopped at the “lotsa waste of time” long time ago.
and whose idea was this to be a jury waived trial? not mine. i’da put the little butt in a courtroom and wasted his time the public is pretty akamai about some outta state kid trying to put da stiff one to us.
btw, i’d let the sun god’s lawyer lead the defense at trial.
whitey….charlie’s recruits are coming in the fall. two tall mb’s. there should be one or two more still.
Schucks Bhf, I wanted you to bring maximum smoke on this little pencil neck!

I’m glad I decided to go into math and education, instead of political science and law. It’s like a totally different language! 😉
Howzit guys!!
Great fun at the vb game tonight. Small contingent of Tsai-kos. Small but vocal crowd. Didja hear Stretch and A-joe? 😆 Keed and friend thought they were very coool. :mrcool:
Keed and friend got to be the ball girls for the 2nd & 3rd game. They loved it. We discussed getting season tickets for next year. 😀
al, thanks. need to thank Coach Wilton for the present mvb team and Coach Wade for getting them to perform at their highest level.

Hello to all the tsaikos!
Hello Mrs. Pang
East Carolina comes to Hawaii with a 6-7 softball record. Five Island girls are on the team, 2 from Kamehameha, 1 Punahou, 1, Kapolei, and 1 from Pearl City. East Carolina recruits Island girls for softball and soccer.
Hiya, Mrs. Long Time UH Fan!!!
Congrats to the Volleybows!!!
I PM’d Sungod today: “Tsai-kos back in Hawaii are praying for your rapid and complete recovery. We are all in His Hands. ”

Seattle University is 0-5 in softball. No Island girls on the roster
Hello all! I wish the WAC would get off their okoles so the football schedule would be complete. I’m really thinking about making a trip home for a game this year. Assuming I’m still in Spokane this fall, I guess going to Boise for the UH game is an option again. I guess I should really find a job before planning trips…
UDUB is 12-1, # 1 rated in softball poll, their lone loss, 7-4 to Utah State. Yeah, go WAC.
This is one of the more interesting posts I’ve read today. Great job. I’m sure I’ll read a lot more of you in future.
Aloha Lorna! Always good to see you on the blog. Thank you for the card. You know we were all very proud to be there for a fellow Tsaiko.
Prayers to Jeff. What a Warrior!
Nitey Night and Sweet Sweep Dreams!
good to see Kazz, Rob, AJoe, PP and JMxxx on tv watching the mvb game.
not a peek from Jm, maybe too busy with mvb, but her oya oya saxa got hugged by huggy bear and his mountaineers today
K State ranked top 5, first time in 50 years. Last time K State was ranked that I high, I got to watch them as a student with Tex Winter coaching. Coaching makes a difference, when he left, a slow downslide that took decades to recover. Frank Martin took over for Huggins at K State, his first head coaching position. Three consecutive 20 game seasons. Can Hawaii do it, probably, find the right coach and not hire a “feel good” kind of coach because he knows Hawaii. Alford has taken New Mexico to a top ten, when can’t we get there?
If New Mexico can afford Alford why can’t UH. New Mexico average between 25K and 30K for football, and 13000+ for bb. UH has better numbers in fb, very low in bb, but expected when you lose and play uninspiring basketball.

I wonder what other offers the Smith family refused. As good as he has been made out to be, of such fine moral character, too, there must have been more than a few major programs who offered him a scholarship.
Bravo to the mvb!
Aloha Kakahiaka!
Have a great Warrior day!
Great Morning All!
More breezy conditions today. Keep those lawn chairs stowed away…
