Has the NCAA become too big and onerous in the accreditation and administration of the sports? Do we need them to have all their complicated rules and regulations?
Maybe KISS should be their new mantra. For me it takes some of the joy and interest out of collegiate sports. Too many infractions because of too many stupid rules. It also has proven to effect the lives of a lot of young students. We have to have rules however not to the point that we have to have legal experts to interpret them. That’s just overkill.

If the UHAD was presented with a copy for “input” prior to the final agreement, then it’s a totally different situation. If the GC Office disregards the UHAD’s input then he/she has not option but to sign the contract.

Business Law – for a contract/agreement to be legal and binding, there must be an offer and acceptance. Therefore, if the UH GC’s Office agreed with a coach’s counsel on a contract, the UHAD has no authority to reject any part of the contract.

As you near the end of the contract, Gib has protected himself against any termination without clause because of the growing liquidated damages to terminate without cause. So the longer Gib stays, the more he builds up job security as long as he gives the UH no cause to fire him. With the NCAA findings, UH had cause to fire him and should have waited to terminate for cause and eliminated the liquidated damages– it was a costly and very stupid mistake not to wait until the NCAA findings to terminate Gib (they could have given him an extension if necessary, because they could terminate that for cause).

I should have said complaints over the contract value (which personally, I never had a problem with). I also thought it was very classy Coach Mack was willing to give 50% of the termination amount back.

I don’t know what is typical or not in coaching contracts, but Arnold’s seem to make it impossible to affordably jettison the coach before the end of his contract without cause.
