Gender discrimination lawsuits in education are nearly always brought under Title IX. There are now even legal theories on how men can potentially make a gender discrimination claim using Title IX. That’s probably another aspect of the use of the law that Congresswomen Mink would be really surprised by. And given what you’ve said about her early thoughts on Title IX, it’s a little ironic then that an athletic complex/park in central Oahu was named after her. Maybe the more apt thing to name after her would have been a school instead…

Thank you for your take on Title IX. agree. my point was that it’s the gender equity requirement that drives the compliance. Title IX set the base. However, if you go back to the very start of Title IX, and I spoke with the late Patsy Mink before her passing in a story back in 2002, this was an educational law. This was to make sure that institutions stopped discriminating against women (and by race, religion, etc) when it came to admission to school. The reason Mrs. Mink went into law was because she was denied admission to medical school, based on her gender. And schools did not hide the fact that they denied the applications because she was a woman.
She was surprised how it ended up being used so powerfully in athletics.
Was just saying that people use the term Title IX when they should be using gender equity.

I’m sure Title IX’s influence still applies to the scenarios being bounced around here. The fact is that scholarships in a given sport where both men and women play aren’t equal (see Bowsfan’s post). Even in basketball — where revenues from the men’s game supports the women’s game and other non-revenue sports — the men get fewer scholarships than the women. We all know, of course, that football throws all the scholarships numbers for a loop. But Title IX’s mandate, in part, results in the disparity in the scholarship numbers in the other sports. Why? Because Title IX is also more than just a equity requirement; the law that has flowed out of the courts and later legislation require, among other things, proportionality with enrollment and with the interest of the genders. Compliance with this, as well as the large demands of collegiate football, have influenced the scholarship levels/numbers of other sports. Any change in those numbers, as is being discussed here, would also necessarily implicate a review for Title IX compliance.

Don’t think it’s ‘obvious’ at all that people on scholarship won’t be on scholarship next year. True that scholarships are renewed every year but Shoji isn’t known to ‘pull’ scholarships.
31. Actually it’s not Title IX, which mandates equality in institutions receiving federal funds. What is being applied is gender equity in terms of the number of playing opportunities offered.

If I remember correctly, it was adopted by the NCAA Board of Directors but then overturned by a membership vote at the 2006 convention.

That Takahara-Dias agreed on Adolpho and Beeman continued the agreement was a gift for volleyball.

29. Non-football playing schools, like the rest of the Big West, still have the same numbers of scholarships. But agree that indoor volleyball should get at least 13, what Shoji has wanted for a while. 12 for position players, 1 for a libero.
